All mechanical, electric, plumbing, and hardscape installations are guaranteed for a period of 2 years from the date of installation.  All plant materials, including but not limited to shrubs, cacti, and vines are guaranteed for a period of 90 days from the completion of the job.  All trees are guaranteed for a period of 1 year from the completion of the job.

• All guarantees and warranties are conditioned upon the BUYER performing normal maintenance after completion, and SELLER shall not be responsible for damage by inclement weather, animals, or any other natural causes beyond the Seller’s control.
• Guarantees and warranties are only effective if the BUYER has complied with all terms, conditions, and payment provisions.
• Unless otherwise specified, the contract price is based upon the BUYER’S representation that the site is cleared not tilled ground or hard dig.  If existing conditions are not represented thereby necessitating additional excavation, or hammer dig, the same shall be paid for by the buyer as additional work.
• In the event that work already performed is damaged by any cause beyond the Seller’s control, all work necessary to replace work already performed shall be considered additional work to be paid for by the BUYER, as additional work.  This would include damage by vandals, animals, other trades, and any other causes beyond the Seller’s control.
• Additions & change orders: Buyer agrees to pay SELLER its normal selling price for all additions, alterations, or deviations.  No work shall be done without prior authorization of BUYER.   NOTE: Special handling and delivery charges will apply to change orders authorized after construction begins.

• Buyer agrees to the type of materials selected for use in construction with the contract.  Included, but not limited to, type of granite, rock, stone, and plant materials.
• Plantings watered by flood irrigation, manual sprinklers, or hand methods are NOT GUARANTEED for any period of time.
• Although a finish rake is performed prior to sodding, some settling, foot or animal traffic may occur requiring a sand leveling, SUCH SAND LEVELING SHALL BE PAID FOR BY BUYER as additional work.
• Unless otherwise stated ROUGH OR FINISH GRADING IS NOT INCLUDED as part of the contract.
• Every effort will be made to match existing materials and textures.  Home owner is to provide and have on site when needed any paint for hardscapes.  No guarantees are made to provide an exact match of Stucco or hardscapes (BBQ, Kiva, Brick, etc…).
• Unless otherwise specified under rough grading seller assumes no liability for water entrapment and damage incurred thereof.
• It is agreed between Buyer and Seller that all materials shall remain the property of Seller until Seller has been paid in full, and SELLER may RETAKE all materials in the event of any default in payment.  Seller has the right to enter upon property to remove any materials.
• When plant varieties specified are not available, SELLER may use a similar substitute, or delete the varieties from the contract by giving a change order credit.
• No guarantees for transplants, including, but not limited to, Ocotillo, Cacti, etc…
• Water features may or may not look similar to any drawings or designs.
• Seller subscribes to Lien services and a pre-lien may be sent with no reflection to the integrity of the buyer.
• BUYER is required to perform normal maintenance as part of the warranty condition of this agreement.
• Normal maintenance conditions vary from site to site and should be determined by a professional maintenance service or horticulturist.  Seller will, upon request, provide an average schedule for water times, but will not assume liability for exact maintenance requirements.
• Screened granite may contain fines that could average between 30% and 50%.  Minus granite contains fines that may appear like soil, the average fines count may be 50% to 70% of granite.
• Cracks in decking and masonry items: Although seller takes every effort to prevent cracking, cracking and veining may occur.  The State of Arizona allows cracks of up to the thickness of a nickel during the warranty period.  Seller will not repair cracks in concrete or masonry that has not measured up to the minimum standards allowed by the State of Arizona.
• Pre-emergent is not weed killer.  Pre-emergent kills approximately 80% of the weed seed in existing soil.  There is no guarantee that all seeds will be destroyed.  And BUYER understands that the pre-emergent should be applied two to three times per year.  SELLER DOES NOT apply pre-emergent beyond the original installation.
• Seller makes no warranty with respect to weeds or grasses, and shall have no liability thereof.
• Red Rock Contractors reserves the right to make adjustments to the printed plan depending on site or other conditions that might arise during the installation / construction process.
• Red Rock Contractors is not responsible for damage to properly staked trees caused by wind, lighting, freezing, or any other inclement weather

NO DEAD PLANT REPLACEMENT BETWEEN JULY 1ST AND SEPTEMBER 15TH.

ALL PLANT REPLACEMENT, IF NEEDED, WILL BE AT THE END OF THE 90 DAY
