Red Rock Pools & Spas warrants that the pool shell will remain structurally sound for as long as you own the pool.  Structurally sound means maintaining the structural integrity of the pool shell so as to withstand all the loads or stresses without cracking and causing water loss.  If it is determined that the pool shell is not sound, Red Rock Pools & Spas will, at no charge to the owner, initiate repairs necessary to restore the structural integrity and water holding ability.  Red Rock Pools & Spas does not warranty against damage to the pool shell caused by improper maintenance, failure to maintain proper water levels, ground water rising above the lowest point of the pool, or damage caused by improper ground prep settling or surrounding soils.

PEBBLE TEC WARRANTY – Red Rock Pools & Spas warrants all Pebble Tec for 5 years per the terms and conditions of Pebble Tec’s Warranty.  Pebble Tec’s warranty states 5 years in the water and 2 years out of the water.  That means that Rolled Bond Beam that sits out of the water will have a warranty of 2 years.

PARAMOUNT WARRANTY – Red Rock Pools & Spas warrants that the Paramount in-floor heads and bodies will be free of defects in material and workmanship and will remain operational for as long as you own the pool per the terms and conditions of Paramount’s in-floor warranty.  There is a 3 year unconditional warranty on the actuator.

5 YEAR UNDERGROUND WARRANTY – All underground installations provided by Red Rock Pools & Spas including pool plumbing, electrical, and gas are warranted to be free of defects in the material and workmanship for a period of 5 years from the date of the pool start-up.

3 YEAR EQUIPMENT WARRANTY – All pool equipment installed by Red Rock Pools & Spas including, salt chlorinators, heaters, pumps, cleaners, control systems, and filters are covered by a 3 year warranty from the date of the pool start-up provided by Red Rock Pools & Spas.  In addition, by using all Pentair products you get a 3 year parts and labor warranty on the complete system.

2 YEAR DECK AND PLASTER WARRANTY – All concrete deck, deck toppings, and plaster are warranted by Red Rock Pools & Spas to be free of defects in material and workmanship for 2 years from the pool start-up.

2 YEAR ACRYLIC DECK SURFACE WARRANTY – All acrylic deck coatings are warranted by Red Rock Pools & Spas to be free of defect in material and workmanship for 2 years.

2 YEAR WORKMANSHIP WARRANTY – Red Rock Pools & Spas warrants that all construction work done per this contract other than noted above to be free of defects in material and workmanship for 2 years from the pool start-up.

FAUX OR REAL ROCK WATER FEATURES – Red Rock Pools & Spas is not responsible for damage caused by irresponsible use of any water features such as jumping off or diving off of into the pool.  Damage means any cracking of rocks and associated plumbing and electrical lines, as well as injury to any persons.  The home owner is responsible for all swimming parties to be safe and responsible when using the pool and water features.

LIMITATIONS

It is the Owner’s responsibility to use the swimming pool in a normal and reasonable manner and the pool shall be operated in accordance with the Red Rock Pools & Spas operating instructions provided to the Owner.  The warranties are effective only if the Owner has complied with all terms and conditions, monetary payments, and other provisions of the original contract.  Red Rock Pools & Spas does not warranty normal maintenance items, such as but not limited to: lubrication of o-ring on backwash valve, pump seals, rocks or debris caught in cleaner or cleaning of D.E. grids.  Red Rock Pools & Spas is not responsible for matching colors or brands if no longer available to Red Rock Pools & Spas, but will make every reasonable effort to match them as closely as possible.  Red Rock Pools & Spas does not warrant any work or materials provided by the Owner or Owner’s agents and shall not be liable for any loss or damage resulting therefrom.

PERFORMANCE

• To obtain performance, the Owner should contact Red Rock Pools & Spas at PO Box 1270, Gilbert, AZ 85299.
• The repair or replacement of non-pool structure items, or of the pool structures as provided above shall constitute the sole and exclusive remedy of the Owner and the fulfillment of all Red Rock Pools & Spas’ liabilities under these warranties whether in warranty, contract or negligence.  Red Rock Pools & Spas shall in no event be liable for incidental, special, or consequential damages arising out of the use, repair, or ownership of the pool.
• In the event Red Rock Pools & Spas is requested to perform any work or service under this Limited Warranty, and a service representative is sent to the pool site and it is determined that no service is required, then the owner shall be responsible to pay to Red Rock Pools & Spas a reasonable service fee for any such service call as determined by the seller.

All warranties stated are non-transferable to another home owner upon sale of the house.  If the house is sold before the warranties have expired, said warranties will become null and void upon sale of the house.
